1. Agreement to these terms
These Terms of Service form an agreement between you and [Company legal name] (“EverAfter Live,” “we,” “us,” or “our”). By creating, managing, viewing, or contributing to an EverAfter Live event, you agree to these terms. If you do not agree, do not use the service.
You must be legally able to enter into this agreement. If you use the service for an organisation or another person, you confirm that you have authority to accept these terms for them.
2. The service
EverAfter Live lets event organisers create a wedding slideshow, upload an opening sequence, invite guests to contribute photos through an event link or QR code, and display submitted content. Features may evolve over time.
3. Event access and management keys
Event organisers receive a private management key. You are responsible for keeping that key secure and for activity performed with it. Guest links are designed to be shared, but management keys are not. Tell us promptly if you believe a key has been compromised.
4. Your content
You retain ownership of photos, captions, names, and other material you submit (“User Content”). You grant us a limited, non-exclusive licence to host, process, reproduce, and display User Content only as needed to operate, secure, and improve the service.
You confirm that you have the rights and permissions needed to submit User Content and to allow its use within the relevant event. Event organisers and contributors are responsible for obtaining appropriate consent from people depicted in uploaded content.
5. Acceptable use
You must not use the service to upload unlawful, infringing, abusive, hateful, sexually exploitative, deceptive, or malicious content; violate another person’s privacy; impersonate others; distribute malware; probe or bypass security; interfere with the service; or use automated means that place an unreasonable load on our systems.
We may remove content or restrict access when we reasonably believe these terms, the law, or another person’s rights have been violated.
6. Availability and changes
We aim to provide a reliable service, but uninterrupted operation is not guaranteed. Uploads and playback may depend on internet access, devices, browsers, displays, and third-party infrastructure outside our control. We may change, suspend, or discontinue features where reasonably necessary.
7. Our intellectual property
The service, brand, software, interface, and original materials—excluding User Content—belong to us or our licensors. These terms do not transfer any ownership rights to you. You may not copy, reverse engineer, resell, or create derivative works from the service except where the law expressly permits it.
8. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that content will always be preserved or playback uninterrupted. Nothing here excludes warranties that cannot lawfully be excluded.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from use of the service. Our total liability for claims relating to the service will not exceed the amount you paid us for the relevant service in the twelve months before the claim, or 100 in the currency of the governing jurisdiction if you paid nothing. Mandatory consumer rights remain unaffected.
10. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access where reasonably necessary to protect users, comply with law, prevent harm, or respond to a material breach. Provisions that by their nature should survive termination will continue to apply.
11. Governing law
These terms are governed by the laws of [Governing jurisdiction], without regard to conflict-of-law rules. Courts located in [Governing jurisdiction] will have jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere.
